You are deemed to have agreed to these terms and conditions once you check the “I have read and I agree to the above terms and conditions box” when signing up for membership, an event or program.
1. Consideration:
You have requested that Single Mingler Events Ltd. provide you with access to our social networking organization.
2. Warranties:
2.1 You warrant that you
a) are single, that is that you are not married nor in a marriage-like relationship with another person;
b) will provide accurate information about yourself in the Single Mingler Events Ltd. application form;
c) will not sexually or verbally harass any other participant(s) in Single Mingler Events Ltd. events or programs either before, during or after the event or activity;
d) are healthy enough to participate in the activities you sign up for, and you agree that you will not put your health or the health of other participants at risk by your engaging in the program or event;
e) you will not disclose personal information you learn about any participants in Single Mingler Events Ltd. events or programs without their express permission;
f) will not attend Single Mingler Events Ltd. programs or events intoxicated, nor operate a motor vehicle after leaving any Single Mingler Events Ltd events or programs;
g) you will not engage in illegal activity at or during any Single Mingler Events Ltd. event or activity; and
h) will not post or publish digitally altered photographs to the world wide web or otherwise circulate digitally altered photographs of participants from Single Mingler Events Ltd. events and programs.
i) Solicitation usually is defined as oral persuasion to join in some endeavor or buy some product or service. In order to provide our Single Minglers with a fun, relaxed atmosphere, we do not allow solicitation or petitioning at our events or programs. No member may distribute any written material at any time with out the written permission of Single Member Management. Any person found to be distributing material or harassing members in pursuit of personal or business gain will be asked to leave the event and possibly the Single Mingler membership.
j) you will pay for any damage you cause to equipment used at any Single Mingler Events Ltd. event or activity.
2.2 Single Mingler Events Ltd. warrants that
a) it is a duly incorporated company under the laws of the province of British Columbia;
b) it is not a dating service. Single Mingler Events Ltd. is a company which facilitates the introduction of single people to other single people by providing social and recreational settings for such meetings.
c) it follows the mandatory provisions of the Personal Information Protection Act. [SBC 2003] c.63 and Single Mingler Events Ltd. will not sell, trade or rent your information to any other business.
d) Single Mingler Events Ltd. will provide only the minimum necessary personal information to third party providers of services to Single Mingler Events Ltd.
3. Cancellation and Renewal of Membership
3.1 If you breach any of the terms and conditions of this agreement, Single Mingler Events Ltd. reserves the right to
a) immediately have you removed from the event or activity; and/or
b) refuse to renew your membership.
3.2 Any waiver of any breach of the terms and conditions of this agreement shall be considered on a case-by-case and incident-by-incident basis and shall be at the sole discretion of Single Mingler Events Ltd..
3.3 If your membership is cancelled by Single Mingler Events Ltd. you are not entitled to any refund of your credits.
4. Fees:
4.1 Sign-up for membership
4.2 Receive unlimited access to the schedule of events and programs and the online member only photo album
4.3 As long as you are a member credits will be stored in your Single Mingler account; unused credits can be saved until needed. Additional credits can be purchased at any time - $30.00 for 30 credits.
4.4 The number of credits each event or activity costs will be listed in the description of that event or activity.
4.5 Some of the events will require that additional fees be paid by participants and the additional fees will be listed in the description of the event or activity, for example Comedy Shows, Hockey or Football games, River Rafting or Wine tours may all require additional fees.
4.6 Membership is not transferable.
4.7 The price of credits in 4.3 may be raised at any time at the sole discretion of Single Mingler Events Ltd..
5. Refunds:
5.1 All sales are final. Single Mingler Events Ltd. will not provide you with a refund for unused credit balances.
5.2 The full number of credits for an event or activity will be returned to your account only if you cancel more than 7 days prior the date of the event or activity.
5.3 Should you fail to show up to an event for which you have registered or should you cancel your registration within 7 days of an event you will not be refunded any credits for use towards another Single Mingler Events Ltd. event or activity.
5.4 Should it become necessary for Single Mingler Events Ltd. to cancel or postpone an event due to inclement weather, or insufficient numbers of participants, Single Mingler Events Ltd. will issue the respective number of credits to your account for that event or activity.
6. Privacy
6.1 Photographs will be taken at all Single Mingle Inc. events and programs and shall be posted on the Single Mingler Events Ltd. web site at the sole discretion of Single Mingler Events Ltd.
6.2 Participants are free to take pictures at events subject to the warranty in paragraph 2.1(h).
7. Waiver of Liability
7.1 You agree to release Single Mingler Events Ltd., its officers, directors, leaders, employees and each member and participant from civil or criminal liability arising from injury, monetary damage or loss sustained by you before, during and after any Single Mingler Event Ltd. event or activity.
7.2 You agree that the release in paragraph 7.1 also releases Single Mingler Events Ltd., its officers, directors, leaders, employees and each member and participant from civil or criminal liability in the event of a law suit instituted by your estate or your family members as a result of injury or monetary damage or loss sustained by you before, during and after any Single Mingler Event Ltd. event or activity.
7. 3 You understand that you are solely responsible for your safety and the safety of your personal property at Single Mingler Events Ltd. events and programs before, during and after such events and programs.
7.4 You agree that Single Mingler Events Ltd. is not responsible for monitoring your alcohol intake at Single Mingler Events Ltd. events and programs and that you take full and total responsibility for your actions under the influence of drugs or alcohol.
